Court dismisses two cases against Benue APC Chairman. The State Legal Adviser of the APC, Matthew Alyebo, petitioned the Makurdi High Court to dismiss two distinct lawsuits brought by Moses Agaba against Augustine Agada and the APC, and by Benjamin Omakolo against the APC. The APC’s legal adviser’s application was based on the lack of diligent prosecution by the plaintiffs.
During the recent proceedings, it was observed that Johnson Usman, representing the plaintiffs, was absent from court without prior notice. Presiding Judge Justice Polycarp Kwahar sided with the APC’s counsel, agreeing that the plaintiffs had effectively abandoned their cases. Consequently, the court ruled to strike out both cases.
Moses Agaba and Benjamin Omakolo had separately taken Austin Agada to court, contesting his legitimacy as Chairman of the APC in Benue State. Mr. Agaba later obtained an interim injunction restraining Austin Agada from acting as Chairman. However, this order was subsequently overturned by a Benue State High Court sitting in Makurdi on February 12, 2024. The state Chief Judge, Maurice Ikpambese, who initially granted the order, acknowledged that the restraining order against Mr. Agada was issued erroneously.
